# 30522: SMS terms must be complete and accessible near the opt-in

## Description

The SMS terms and conditions are missing, incomplete, or not accessible. Terms must be complete, publicly accessible, and linked as visible text near the opt-in, not hidden in a pop-up.

### Possible causes

* No terms and conditions were provided, either as a live hyperlink or a copy block.
* The terms are missing required compliance elements.
* The terms are shown in a pop-up window, which is not permitted.
* The terms link is broken or not accessible.

### Possible solutions

* Include all required elements: program or business name, product description, message frequency, customer care contact, opt-out instructions, and the "message and data rates may apply" disclosure.
* Add a carrier liability disclosure stating that wireless carriers are not liable for delayed or undelivered messages.
* Place direct text links labeled Terms of Service and Privacy Policy close to the opt-in, not in pop-ups, dropdowns, or far from the phone number field.
* Make the terms link publicly accessible and active.
